1. Agreement to Terms

By accessing or using Mnemosyne ("the Service"), available at mnemosyne.live, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Mnemosyne is a trading journal and analysis platform that allows users to record, organize, and review their trading activity. The Service provides tools for trade logging, top-down analysis, execution tracking, performance review, backtesting, and related analytical features.

The Service is currently in beta and is provided free of charge. We reserve the right to introduce paid subscription plans in the future, with reasonable notice to existing users.

3. Account Registration

To use the Service, you must create an account by providing a valid email address, your first and last name, and a password. You must verify your email address before accessing the Service. You agree to:

• Provide accurate and complete registration information;
• Use a genuine, non-disposable email address;
• Maintain the security of your account credentials;
• Notify us immediately of any unauthorized access to your account;
• Accept responsibility for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose;
• Attempt to gain unauthorized access to the Service or its related systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Upload or transmit viruses, malware, or other harmful content;
• Use automated means (bots, scrapers) to access the Service without prior written consent;
• Reverse engineer, decompile, or disassemble any part of the Service;
• Share your account credentials with third parties.

5. User Content

You retain ownership of all content you submit to the Service, including trade data, analysis notes, images, and annotations ("User Content"). By using the Service, you grant Mnemosyne a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

You are solely responsible for your User Content. You represent that you have the necessary rights to upload any content you submit to the Service.

6. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Mnemosyne and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

7. Beta Service

The Service is currently offered as a beta product. This means it may contain bugs, errors, or incomplete features. We provide the Service on an "as is" and "as available" basis during the beta period. We may modify, suspend, or discontinue features at any time without prior notice.

8. Future Pricing

We reserve the right to introduce paid subscription plans in the future. If we do, we will provide existing users with at least 30 days' notice before any charges apply. You will not be charged without your explicit consent. If you do not wish to subscribe, you may export your data and close your account.

9. Disclaimer of Financial Advice

Mnemosyne is a journaling and analysis tool. It does not provide financial advice, investment recommendations, or trading signals. Any analysis, statistics, or insights generated by the Service are for informational and educational purposes only. You are solely responsible for your trading and investment decisions. 10. Limitation of Liability

To the maximum extent permitted by applicable law, Mnemosyne and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Mnemosyne and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Your Data & Account Deletion

You can export all your data at any time using the data export feature in your account settings, which provides a complete download in JSON format. You can also permanently delete your account and all associated data using the account deletion feature in your account settings.

Upon account deletion, all your personal data, trading data, analyses, uploaded images, and configuration data are permanently removed. This action is irreversible.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service. You may close your account at any time using the account deletion feature or by contacting us. Upon termination, your right to use the Service ceases immediately. We recommend exporting your data before deleting your account.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which the operator resides. Any disputes shall be resolved in the competent courts of that jurisdiction.
